Terms of Use

These Terms of Use ("Terms") govern your use of the Big Sendies mobile application ("App") operated by Brandon Wolf ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The App

Big Sendies is a climbing session tracker that lets you log climbs, track progress, discover locations, and connect with other climbers. The App is available on iOS via the Apple App Store.

2. Free Tier

Big Sendies is free to download and use. Free accounts may log up to 30 climbs per calendar month. This limit resets on the first day of each month in your local timezone. Once the limit is reached, logging new climbs requires a Big Sendies Pro subscription.

3. Big Sendies Pro Subscription

Big Sendies Pro is an auto-renewing subscription that removes the monthly climb limit and unlocks additional features.

Price and billing period — as displayed on the subscription screen in the App and in the Apple App Store at the time of purchase.
Free trial — if a free trial is offered, it will be shown before you confirm your purchase. Unused trial time is forfeited when you make a purchase.
Auto-renewal — your subscription automatically renews at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours of the end of the current period.
Managing your subscription — you can turn off auto-renewal at any time in your iOS Settings: Settings → [your name] → Subscriptions. Cancelling stops future charges but does not issue a refund for the current period.
Refunds — all payments are processed by Apple. Refund requests must be made directly to Apple at reportaproblem.apple.com.

4. Apple as Merchant of Record

All in-app purchases are facilitated by Apple through the App Store. By making a purchase, you also agree to Apple's App Store Terms of Service. We do not collect or store your payment information.

5. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 13 years old to create an account. If you believe your account has been compromised, contact us immediately at support@bigsendies.com.

6. User Content

You retain ownership of content you create in the App (climb logs, notes, photos). By uploading content, you grant us a limited, non-exclusive licence to store and display it solely to operate the App's features (e.g. showing your climbs on your profile and in friends' feeds). We do not claim ownership of your data.

You agree not to upload content that is unlawful, harmful, or infringes on the rights of others. We reserve the right to remove content that violates these Terms.

7. Acceptable Use

You agree not to:

Use the App for any unlawful purpose.
Attempt to reverse-engineer, decompile, or tamper with the App.
Use automated tools to scrape or extract data from the App.
Impersonate another user or create false accounts.
Interfere with the security or integrity of the App or its infrastructure.

8. Intellectual Property

The Big Sendies name, logo, design, and all original content in the App are owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you a right to use our trademarks or branding.

9. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or that any data will be retained indefinitely. Climbing is an inherently risky activity — the App is a tracking tool only and does not provide safety guidance or instruction.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data or loss of climb records.

11. Termination

You can stop using the App and delete your account at any time from Settings → Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top. Continued use of the App after changes constitutes acceptance of the updated Terms.
